With effect from 1 January 2013, the section in the Code of Civil Procedure (CCP) on the proceedings on the grant of permission to accept
or detain a person in a health care institution (Article 191a to Article 191h of the CCP) was amended by Act No. 404/2012 Coll. What in this
amendment is relevant and new for health care professionals and what has to be changed in their practice? In particular, it is the fact
that the consent of the guardian of a person deprived of or restricted in their legal capacity does not replace the consent of the institutionalized
person. The article also summarizes additional changes in the CCP and the resulting recommended changes in psychiatric
practice. The article deals with the amended Act on Health Services that has become effective on March 14, 2013.
